Digital Will vs Physical Will: Which One Do You Need?
Understanding the legal validity, convenience, and protection of both formats
Only about 10% of Indians have a will. Among those who do, most have a simple handwritten or typed document — often unsigned by witnesses, sometimes locked in a drawer that nobody knows about. The will exists, but functionally, it might as well not.
The conversation around wills in India is changing. Digital wills — created, stored, and managed electronically — are gaining recognition. But how do they compare to traditional physical wills? And does Indian law even recognise them?
What Indian Law Says About Wills
Under the Indian Succession Act, 1925 and the Hindu Succession Act, 1956, a will is valid if it meets certain conditions — regardless of whether it's on paper or electronic. The key requirements are: the testator (person making the will) must be of sound mind, the will must be signed, and it should be witnessed by at least two people.
Section 63 of the Indian Succession Act does not specify that a will must be on physical paper. This means a digitally created document can serve as a valid will — provided it meets the same signing and witnessing requirements.
The Information Technology Act, 2000 gives legal recognition to electronic records. While wills are excluded from the IT Act's e-signature provisions, a printed and witnessed digital will holds the same legal weight as a handwritten one.
Physical Will: The Traditional Approach
A physical will is handwritten or typed on paper, signed by the testator, and witnessed by two people. It can be registered (optional but recommended) at the local Sub-Registrar's office.
- Universally understood by courts and legal professionals
- Can be registered for added legal protection (under the Registration Act)
- Physical storage creates risk — fire, water damage, loss, or theft
- Difficult to update — amendments require a codicil or a new will
- Family may not know it exists or where it's stored
Digital Will: The Modern Alternative
A digital will is created using an online platform, stored electronically, and can include detailed asset allocation, trusted contact notifications, and automatic delivery mechanisms.
- Easy to create, update, and manage from anywhere
- Secure digital storage with encryption — no risk of physical damage
- Can include detailed instructions, messages, and even video notes
- Trusted contacts can be notified automatically when needed
- Should still be printed, signed, and witnessed for full legal validity
- Some courts may require additional proof of authenticity for purely electronic wills
Which One Should You Choose?
The honest answer is: both work. What matters more than the format is whether the will exists, is legally valid, and can be found by your family when they need it.
For most Indian families, the ideal approach combines both — create your will digitally (for easy updating and secure storage), then print and sign a physical copy with witnesses. This gives you the convenience of digital and the legal certainty of physical.
Afterlife's Digital Will feature lets you create, store, and update your will online. When you're ready, print and sign it — and rest easy knowing a secure digital copy is always accessible to your trusted contacts.
What to Include in Your Will
Regardless of format, every Indian will should cover these essentials:
- Full name, address, and identification details of the testator
- A clear declaration that this is your last will, revoking all previous versions
- Detailed list of assets — bank accounts, property, investments, insurance, digital assets
- Clear beneficiary designations — who gets what, and in what proportion
- Appointment of an executor — the person responsible for carrying out the will
- Signatures of the testator and two witnesses (who are not beneficiaries)
- Date and place of signing
A will doesn't have to be complicated. It doesn't have to be done by a lawyer (though legal review is always smart). It just has to exist, be valid, and be findable. Whether you write it on paper or create it on Afterlife, the most important step is starting.
Your family deserves clarity. Give them that gift today.
